A divorce -- referred to in some states as a dissolution of marriage -- is a decree by a court that a valid marriage no longer exists. A divorce leaves both parties free to remarry. It usually provides for division of property and makes arrangements for child custody and support.
Although divorces may be emotionally contentious, most divorces (probably more than 95 percent) do not end up in a contested trial. Usually the parties negotiate and settle such things as division of property, spousal support, and child custody between themselves, often with an attorney's help. Sometimes parties reach an agreement by mediation, with a trained mediator who tries to help husband and wife identify and accommodate common interests. The parties then present their negotiated or mediated agreement to a judge. Approval is virtually automatic if the agreement appears to meet a minimal standard of fairness.
If parties are unable to agree about property, support, and child custody, they may ask the court to decide one or more of those issues.
A threshold requirement for obtaining a divorce in most states is residency or domicile of one or both parties who are to be divorced. "Residency" refers to the state in which a person lives; "domicile" refers to the state that the person regards as "home." Usually the state of a person's residency and domicile are the same, but sometimes they can be different. For example, a couple may reside four months each year in the state of their "summer home", but regard another state where they spend the rest of the year as their true home (and that state would be the state of their domicile).
Residency (or domicile) requirements vary. A few states have no residency requirement. That means a person can arrive in a state and seek a divorce on the same day. Residency requirements of other states range from six weeks to one year; six months is the most common time period. In states with a residency requirement, a party must have lived in the state for the specified period before a divorce can be granted.
The party seeking a divorce must state a ground for divorce in the papers filed with the court. The grounds may be based on no-fault or fault, depending on the state. All states now offer no-fault divorces; approximately thirty-two states also offer fault-based grounds as an additional option. (See chart.)
A no-fault divorce is a divorce in which neither the wife nor husband blames the other for breakdown of the marriage. There are no accusations necessary to obtain a divorce--no need to prove "guilt" or "fault". Common bases for a no-fault divorce are "irreconcilable differences," "irretrievable breakdown," or "incompatibility." As those terms imply, the marriage is considered to be over, but the court and the legal documents do not try to assign blame.
Another common basis for a no-fault divorce is that the parties have lived separately for a certain period of time, such as for six months or a year, with the intent that the separation be permanent.
Over the last thirty-five years, "no-fault" has replaced "fault" as the dominant basis for obtaining a divorce. No-fault divorces are considered a more humane and realistic way to end a marriage. Husbands and wives who are divorcing usually are suffering enough without adding more fuel to the emotional fires by trying to prove who-did-what-to-whom. The laws of no-fault divorce recognize that human relationships are complex and that it is difficult to prove that a marriage broke down solely because of what one person did.
Some critics of no-fault divorces are concerned that an economically dependent spouse may not be adequately protected when it is so easy for the other spouse to obtain a divorce. The critics argue that no-fault divorces result in lower awards of property and support to economically dependent spouses than fault-based divorces. Proof of cause-and-effect on this issue is far from certain.
In the approximately thirty-two states that allow divorces based on fault (in addition to no-fault divorces), the grounds for fault-based divorces vary. Here is the laundry list (one might say dirty laundry list) of grounds:
• adultery
• physical cruelty
• mental cruelty
• attempted murder
• desertion
• habitual drunkenness
• use of addictive drugs
• insanity
• impotency (usually unknown to the partner at the time of marriage)
• infection of one's spouse with venereal disease
Husbands or wives in the mood for revenge probably could come up with a multi-count complaint. Some spouses want the emotional release of proving fault by their mates. But courts are not a very good forum for such personal issues, and the accuser is usually less satisfied than he or she expected to be. The degree to which "fault" affects division of property, support, and custody will be discussed in the chapters on those subjects.
Divorce: What It Can and Cannot Do for You
Normally, people contemplating divorce have some idea of what to expect from a divorce. They have witnessed divorces on television and in movies, and often personally know at least a handful of people who have been through a divorce. Increasingly, people have also experienced their own parents' divorce. In spite of this "second-hand" experience, facing your own divorce is one of the more frightening events in life. Not only do you face a court-sanctioned ending of possibly one of the more significant relationships you have ever had, you also must begin to think about such unpleasant things as the division of property and new living accommodations. In many cases, there is also the unhappy prospect of no longer seeing your children on a daily basis.
Predictability and divorce do not go together. But, armed with realistic expectations, you will have the best chance of being satisfied with the end result of your divorce. Consequently, it is wise to understand the realities of what a divorce can and cannot do for you.
What Divorce Can Do
Property Division. A divorce court will attempt to divide the property of a marriage in the most economic way possible. Most states will exclude from this division any property that was acquired prior to the marriage or that was acquired via gift or inheritance. In some states (community property states) this involves a 50/50 split of the property acquired by the parties during the marriage. Other states (non-community property states) will inquire into the couple's individual financial circumstances, financial plans for the future, and other relevant matters in attempting an equitable distribution of the property.
Because the division of property is never predictable, if you have a strong need for some item of property, it may be best to have your attorney negotiate and settle the property distribution ahead of time with your spouse's attorney. For example, you may decide that, although you would really like to stay in the family home, you really need to keep your business. Therefore, you might forgo the home in favor of the business. In this manner, you can attempt to strike a mutually satisfying agreement for dividing property with your spouse.
Support Obligations. Courts will also determine a couple's support obligations. This can come in the form of child support and spousal support (also called "alimony"). Child support payments are now largely set by state law, but deviation from those standards are not uncommon. Also, child support orders may depend on the custody arrangements ordered. In general, spousal support largely depends on the facts of each divorce and the divorcing couple's financial circumstances. Therefore, here again, any attempt at predicting a court's ultimate support decision is often difficult.
Child Custody and Visitation. Aside from the distribution of wealth, the other main function of the divorce court is to set child custody and visitation schedules. This too is anything but predictable. While courts often try to make their decision based on a set of factors said to promote the "best interest" of the child, these decisions can vary from case to case and court to court. After all, in making custody decisions judges are naturally influenced by their own beliefs, opinions and values. Further, judges usually see and hear only the worst of people during heated custody proceedings. So, based on their limited "view" into the parents' lives, a divorce court may not always make the "best" possible decision when it comes to custody. Here again, negotiation and settlement are important options to keep in mind. Everybody involved in the divorce, especially the children, will benefit from a cooperative child custody arrangement.
What Divorce Cannot Do
Guarantee Precise and Equal Division. A divorce cannot accomplish an exact or mathematically equal division of property and time with children. Because no two people, no two marriages, and no two divorces are alike, the judge who enters a divorce order must make the best decision with the limited time and information available. It may not always be the fairest possible decision that could have been reached, and it is certain not to favor you individually in every possible way. Divorce courts often have to make the best of terrible circumstances. For instance, there can be no satisfactory custody arrangement when one parent lives in Cheyenne, Wyoming and the other lives in Kalamazoo, Michigan.
Ensure Civil Relations. Even though a court can set custody and visitation arrangements, it will not be present every Friday when it is time for mom to drop off the kids, and it will not spend the weekend with dad, making sure he does not make snide comments about mom around the children. Ultimately, a court order is just a piece of paper. Mom and dad will STILL have to civilly deal with each other to carry out the terms of the custody and visitation order. Divorce does not take away your responsibility towards your children, and this includes dealing with their other parent, because divorce does not make your ex-spouse any less your child's parent (one exception being cases of abuse).
Maintain Your Standard of Living. You should also recognize that a divorce court cannot increase your salary to prevent your standard of living from declining once you divorce. Unfortunately, from an economic standpoint, it is simply much cheaper for two people to live together and share expenses than it is to maintain two separate households. Divorce will change your standard of living and there is little, if anything, the court can do about the change.
Resolve Emotional Issues. Finally, a court will not be able to punish your ex-spouse or morally vindicate you for all of the bad things that happened while you were married. Moreover, the divorce process will not heal your emotional wounds or even take away the necessity of grieving the failed relationship. That is your job, although you can seek assistance through therapists and support groups.
A Divorce Timeline
When people decide to get a divorce, they usually don't know what to expect. Divorce is a complicated legal process, and it can be full of unpleasant surprises and frustrating delays. A general understanding of what's likely to happen can help you feel more comfortable at an uncomfortable time. The following chronology gives a general idea of how the average divorce proceeds. Your divorce may be a little different because of differences among state laws or because of specific issues between you and your spouse.
1. To start off the divorce, one of the spouses gets a lawyer, who writes up a petition (also known as a complaint), a legal document that says why the spouse wants a divorce and how he or she wants to settle financial, custody, and other issues.
2. The lawyer files the petition or complaint with the court.
3. The lawyer or the court makes sure that the petition/complaint is served on the other spouse, together with a summons that requires that spouse's response.
4. The served spouse has to answer within a certain time (usually about three weeks). The answer says whether or not the served spouse agrees with the petition/complaint. If he or she doesn't answer the petition/complaint, the court assumes that he or she agrees to its terms. The answer (also called a response) indicates how the served spouse would prefer to deal with divorce decisions.
5. The couple exchanges documents and information on issues such as property and income. By examining this information, the couple and the court can decide how to divide up property and how to deal with child support and alimony.
6. Sometimes, the couple can voluntarily resolve all their issues through mediation or settlement. Some states require that divorcing couples go through this process.
7. If a settlement is reached, the settlement agreement is shown to a judge at an informal hearing. The judge will ask a few basic factual questions and whether each party understands and chose to sign the agreement.
8. If the judge approves the agreement, he or she gives the couple a divorce decree that shows what they agreed to. If he or she does not approve it, or if the couple does not reach an agreement, the case will go to trial.
9. At trial, attorneys present evidence and arguments for each side, and the judge decides the unresolved issues, including child custody and visitation, child and spousal support, and property division. Once the judge has reached his or her decision, the judge grants the divorce.
10. Either or both spouses can appeal a judge's decision to a higher court. But it's unusual for an appeals court to overturn a judge's decision. Also, remember that settlements usually cannot be appealed if both spouses agree to their terms.
It's hard to say how long all these steps will take in your case. The entire process can take from as little as a few months, to as long as several years. Generally speaking, the more the couple can cooperate and agree to reasonable compromises, the smoother and faster the divorce will go.
Impact of Divorce on Spouses
Divorce, of course, is a stressful time in a person's life. Emotional reactions include depression, anger, jealously, humiliation, disorientation and sense of loss.
The sense of loss arises not only from loss of positive aspects of a marriage, but also from loss of negative aspects of a marriage. Divorce researchers Andre Derdeyn and Elizabeth Scott have written: "The sense of loss can be just as great if the relationship had long since been almost exclusively negative and conflictual. . . . '[T]he intensity of grief is related to the intensity of involvement rather than of love.' For many spouses, the marriage--whether dominantly positive or negative--was an integral part of their emotional being and the loss of the marriage can be very disruptive."
Judith Wallerstein and Joan Kelly, who research the effect of divorce on parents and children, found that the average time after a divorce for women to reestablish "inner equilibrium," "external stability" and "a sense of continuity in their lives" was three to three and a half years. For men, the average time to reestablish continuity was two to two and a half years. Men had a shorter recovery time than women because men, as a group, had more external supports, including greater financial security and job satisfaction to help the transition process.
Although most spouses recover from divorce with the passage of time, some do not. For those who do not recover, the decline in adult functioning becomes chronic. Spouses who are not able to regain equilibrium often had their primary identity wrapped up in the marriage and have few inner or external resources on which to fall back.
Parents who divorce often find that their parenting skills drop during the period of divorce. In the time surrounding a divorce, it is common for parents to become more self-centered and less available to the child as parents cope with their own wounds. In most (but not all) cases, parenting skills return to normal after a few years.
Annulment vs. Divorce
When you can get an annulment instead of a divorce.
Like a divorce, an annulment is a court procedure that dissolves a marriage. But, unlike a divorce, an annulment treats the marriage as though it never happened. For some people, divorce carries a stigma, and they would prefer to have their marriage annulled. Others prefer an annulment because it may be easier to remarry in their church if they go through an annulment rather than a divorce.
There are two types of annulment: civil annulment (by the state government) and religious annulment (by a church).
Grounds for Civil Annulment
Grounds for civil annulment vary slightly from state to state. Generally, an annulment requires that at least one of the following reasons exists:
Misrepresentation or fraud. For example, if a spouse lied about her capacity to have children, that she had reached the age of consent, or that she was not married to someone else, an annulment could be granted.
Concealment. For example, if a spouse concealed an addiction to alcohol or drugs, a felony conviction, children from a prior relationship, a sexually transmitted disease, or impotency, an annulment might be granted.
Refusal or inability to consummate the marriage. Refusal or inability of a spouse to have sexual intercourse with the other spouse can be grounds for an annulment.
Misunderstanding. For example, if one person wanted children and the other did not, an annulment might be granted.
Most annulments take place after marriages of a very short duration -- a few weeks or months -- so there are usually no assets or debts to divide, or children for whom custody, visitation, and child support are a concern.
When a long-term marriage is annulled, however, most states have provisions for dividing property and debts, as well as determining custody, visitation, child support, and alimony. Children of an annulled marriage are not considered illegitimate.
Religious Annulments
Within the Roman Catholic Church, a couple may obtain a religious annulment after obtaining a civil divorce, so that one or both people may remarry, within the church or anywhere else, and have the second union recognized by the church. The grounds for annulments in the Catholic Church are different than for civil annulments

Un divorcio deja a ambas partes libres para volver a casarse. Generalmente establece división de los bienes y llega a acuerdo para la mantención y custodia de los menores.
A pesar de que los divorcios pueden ser emocionalmente contenciosos, la mayoría de ellos (probablemente más del 95 por ciento) no termina en un juicio controvertido. Generalmente las partes negocian entre ellas y fijan dichas cosas como división de los bienes, pensión alimenticia y custodia de los menores, frecuentemente con la ayuda de un abogado. Divorcio: qué puede y no puede hacer por usted
Es común que las personas que están pensando en un divorcio tengan una idea general sobre qué esperar de éste. Han observado divorcios en televisión o en el cine y a menudo conocen al menos a un grupo de personas que ha pasado por la experiencia de un divorcio. Con cada vez mayor frecuencia las personas han experimentado el divorcio de sus propios padres. A pesar de esta experiencia de "segunda mano", enfrentar su propio divorcio es uno de los acontecimientos más atemorizantes de la vida; ya que no sólo enfrenta un final aprobado por el tribunal de probablemente una de las relaciones más significativas que ha tenido en su vida, sino además debe comenzar a pensar en cosas tan desagradables como división de los bienes y un nuevo lugar donde vivir. La responsabilidad hacia sus hijos no desaparece con el divorcio y esto incluye tratar con el otro progenitor, ya que no por estar divorciados, su ex cónyuge deja de ser el padre/madre de su hijo (siendo una excepción los casos de abuso).
Mantener su estándar de vida: También debe tenerse presente que una vez que usted se divorcie, un tribunal de divorcio no puede aumentar su sueldo para evitar que usted modifique su estándar de vida. Por desgracia, desde un punto de vista económico, es mucho más barato que dos personas vivan juntas y compartan sus gastos, a que mantengan dos casas separadas. Su estándar de vida se verá alterado con el divorcio y no hay mucho que el tribunal pueda hacer al respecto.
Resolver temas emocionales: Finalmente, un tribunal no será capaz de castigar a su ex cónyuge o reivindicarle a usted moralmente por todo lo malo que sucedió mientras ustedes estuvieron casados. Sus heridas emocionales no serán sanadas con el proceso de divorcio, ni éste tampoco podrá hacerse cargo de su necesidad de lamentar esta relación fallida. Cronología del divorcio
Generalmente cuando las personas deciden solicitar un divorcio, no tienen idea de qué esperar. El divorcio es un proceso legal complicado y puede estar colmado de desagradables sorpresas y demoras frustrantes. En momentos desagradables como éste, una comprensión general de lo que puede suceder, puede ayudarle a sentirse más cómodo. La siguiente secuencia nos entrega una idea general de cómo funciona el divorcio promedio. Puede que su divorcio sea distinto debido a las diferencias entre las leyes de estados, o por temas específicos entre usted y su cónyuge.
1. Para comenzar el proceso de divorcio uno de los cónyuges contrata a un abogado quien redacta una demanda (también conocida como querella), un documento legal que indica porqué el/la cónyuge quiere el divorcio y cómo quiere resolver los temas financieros, de custodia de menores y otros.
2. El abogado interpone la demanda o querella en el tribunal.
3. El abogado o el tribunal se asegura que la demanda/querella sea notificada al otro cónyuge, junto con una citación que precisa una respuesta de dicho cónyuge.
4. El cónyuge notificado tiene que responder dentro de una cierta cantidad de tiempo (generalmente alrededor de tres semanas). La respuesta dice si el cónyuge notificado está o no de acuerdo con la demanda/querella. Si él o ella no responde la demanda/querella, el tribunal asume que él o ella están de acuerdo con los términos. El cónyuge notificado indica en la respuesta (también denominada contestación) cómo preferiría pactar las decisiones del divorcio.
5. En temas como bienes e ingresos la pareja intercambia documentos e información. Al examinar esta información, el tribunal y la pareja pueden decidir cómo dividir los bienes y cómo tratar sobre mantención de los hijos y pensión alimenticia de la mujer.
6. Una pareja puede resolver todos sus asuntos voluntariamente a través de mediación o acuerdo. Hay estados que requieren que las parejas que se están divorciando pasen por este proceso.
7. En caso de llegar a acuerdo, se exhibe el acuerdo de conciliación al juez en una audiencia preparatoria. El juez hará unas pocas preguntas basadas en los hechos y corroborará si ambas partes comprenden y escogen firmar el acuerdo.

Es muy difícil decir cuánto se demorarán todos estos pasos en su caso. El proceso completo puede demorarse tan poco como un par de meses, o demorarse demasiado, como por ejemplo, varios años. En general, cuanto más coopere una pareja y mientras más sea capaz de llegar a compromisos razonables, más rápido será el proceso de divorcio.
Impacto del Divorcio en los cónyuges
No cabe duda que el divorcio es un período estresante en la vida de una persona. Entre las reacciones emocionales derivadas de éste podemos incluir depresión, rabia, celos, humillación, desorientación y sensación de pérdida.

Según los investigadores Andre Derdeyn y Elizabeth Scott: “La sensación de pérdida puede ser igual de fuerte aún cuando la relación haya sido exclusivamente negativa y conflictiva durante mucho tiempo. . . ‘La intensidad del dolor está relacionada directamente con la intensidad de la relación más que con la intensidad del amor’ Para muchos cónyuges, el matrimonio—ya sea que haya sido dominantemente positivo o negativo—fue una parte integral de su ser emocional y la pérdida del matrimonio puede ser muy perjudicial.”
Según Judith Wallerstein y Joan Nelly, quienes se dedican a investigar los efectos del divorcio en padres e hijos, descubrieron que el tiempo promedio que toma a una mujer reestablecer su “equilibrio interior”, "estabilidad externa” y “sentido de continuidad en sus vidas”, era de tres a tres años y medio. A pesar de que la mayoría de los cónyuges se recupera del divorcio con el paso del tiempo, hay algunos que no lo logran. Para aquéllos que no lo logran, el deterioro en su funcionamiento adulto se convierte en crónico. Aquéllos cónyuges que no son capaces de recuperar el equilibrio, generalmente es debido a que tuvieron su identidad principal volcada al matrimonio y tuvieron menos recursos internos o externos en qué apoyarse.
Aquéllos padres que se divorcian generalmente se dan cuenta que sus habilidades para actuar como padre o madre decaen durante el período del divorcio. Durante el tiempo que dura el proceso del divorcio, es común que los padres se vuelvan más egocéntricos y menos disponibles para el niño/niña mientras hacen frente a sus propias heridas. En la mayoría de los casos (pero no todos) las habilidades de crianza vuelven a estabilizarse luego de algunos años.
Nulidad versus Divorcio:
Cuándo puede usted obtener la nulidad en lugar del divorcio.
Tal como el divorcio, la nulidad es un procedimiento del tribunal que disuelve el matrimonio. Pero, a diferencia del divorcio, la nulidad trata al matrimonio como si nunca hubiera existido. Para algunas personas el divorcio acarrea un estigma y preferirían solicitar una nulidad. Otros prefieren la nulidad porque será más fácil volver a casarse en su iglesia si escogen esta opción en lugar del divorcio.
Hay dos clases de nulidad: nulidad civil (por el gobierno estatal) y nulidad religiosa (por una iglesia).
Causas de Nulidad Civil
Las causas para la nulidad civil varían levemente entre estados. Por lo general, la nulidad requiere que al menos exista una de las siguientes razones:
Declaración falsa o fraude. Por ejemplo si un cónyuge mintió sobre su capacidad para engendrar hijos, o engañó sobre el hecho que ya tenía la mayoría de edad, o declaró que no estaba casado/casada con alguien más, se puede conceder la nulidad.

La mayoría de las nulidades surge luego de matrimonios de muy corta duración – unas pocas semanas o meses -- así es que generalmente no hay bienes o deudas que dividir; o hijos, en donde preocupe la custodia, visitas o mantención.
Sin embargo, cuando un matrimonio que ha durado años se anula, la mayoría de los estados tienen estipulaciones para dividir la propiedad y las deudas, tanto como para determinar la custodia, visitas, mantención de los hijos y pensión alimenticia de la mujer. The hourly billing rate of the attorneys in our office here in São Paulo vary from US$ 320,00, the highest to US$ 55,00, which corresponds to that of our most junior associated. De acuerdo a las exigencias de la norma, los niveles de iluminación, medidos en unidades de luminancia, serán decrecientes desde cada zona de acceso hacia el interior. Los niveles mínimos que deberá asegurar el sistema de iluminación ofrecido en las zonas de umbral se muestran en la Tabla 1, la cual ha sido calculada de acuerdo a las condiciones definidas en la Norma CIE 88 y a las disposiciones del Manual de Carreteras del MOPTT; también se fijó de acuerdo a esta norma la luminancia de la zona interior de los túneles, Li. El escalonamiento de valores de luminancia, entre la zona de umbral y el interior deberá definirlo el proponente según su criterio de diseño. No obstante lo anterior el escalonamiento propuesto deberá cumplir con las exigencias de las secciones 5.2 y 5.3 de la norma CIE 88.
En particular, las luminancias de cada zona del túnel se determinarán, con las restricciones que se indican en la figura 2, según la curva de variación de iluminación definida en la norma citada, la que se reproduce en la figura siguiente.

El Proveedor entregará el estudio de las condiciones de iluminación para cada una de las entradas definidas en la Tabla 1 que deberá mostrar las curvas de adaptación correspondientes que hayan resultado de su estudio. Estas curvas se determinarán de acuerdo a las siguientes condiciones:

Source text - English In 1938, Lacassagne showed that there was a causal association between the endogenous sex steroids and the neoplastic process. Since then a large amount of experimental data has accumulated indicating that estrogen administration is followed by routinely reproducible tumors in five species of animals and in eight organ sites. These included tumors of the breast, cervix, endometrium, ovary, pituitary, testicles, kidney and bone marrow, in either mice, rats, rabbits, hamsters, or dogs. Thus, sex steroids (endogenous and derivatives) have been considered either to be carcinogens or suspect carcinogens. However, the accumulated evidence from the scientific literature and the consensus of opinion of scientific experts is that these hormonally active substances are not carcinogenic "per se" but act as promoters once the carcinogenic process has been initiated by chemical, physical or viral agents.
