Source text - Italian La scuola del positivismo giuridico ci ha insegnato che il patto originario di ciascuna società è quello in forza del quale i cittadini riconoscono ad alcuni di essi il diritto di emanare le norme fondamentali, che costituiscono il punto di partenza di tutta la disciplina positiva del diritto.

Questa non è, come ha ricordato Natalino Irti nel suo nuovissimo saggio Diritto senza verità, una scelta meramente del giurista, che sceglie la norma fondamentale e sulla base di essa declina tutte le norme accessorie, ma è , è regola che non ci è data, ma viene riconosciuta da ciascuno ad un tempo come limite e protezione della propria volontà; essa segna l'inizio del diritto, del diritto di ciascuno di noi, a cui accettiamo di piegare la nostra volontà.
Ad analoghi valori fondanti, se ben ci si riflette, pervengono anche le teorie del naturalismo che, pur respingendo la strutturazione idealistica, giungono comunque a valorizzare i fondamenti della convivenza, tratti questa volta non dal dogmatismo kelseniano, ma dall'osservazione e dall'esperienza dei valori naturali, posti a fondamento della conventio ad includendum che disciplina il patto sociale.
La proiezione di questi principi etici nel mondo della giustizia è evidente allorché si rifletta sulla circostanza che la Giustizia, nella sua declinazione concreta, si attua nell’esercizio della giurisdizione e che, quindi, agire in modo etico per l’operatore del diritto significa rispettare i valori fondanti del sistema giurisdizionale, sia come parte, sia che come terzo.

Legal positivism scholars have taught us that the original covenant underlying all societies is that whereby citizens afford some of them the right to issue the fundamental rules that make up the starting point for all statutory legal rules. In 1916, Giovanni Gentile remarked in his "Foundations of Legal Philosophy" that "the fundamental law is that of abiding by the law; hence, assuming a fundamental law, one recognises and abides by all the specific rules for which that fundamental law is a precondition."
As recalled by Natalino Irti in his recent essay on "Law without Truth" [Diritto senza verità], this is not a choice that is only applicable to legal scholars, who select the fundamental law and use it as the standard to measure all ancillary laws; in fact, it is "a core principle of our world...", it is a rule that has not been handed down to us, because it is recognised by each and every one to be both a limitation on and a guarantee of one's own volition. It marks the beginning of law, the law applying to all of us, and we accept to subject our volition to this law.
Similar founding values are also the outcome of naturalistic theories, which reject the framework set up by idealism but attach pivotal importance to the foundations of co-existence; however, such foundations do not result from Kelsen's dogmatism and stem actually from the observation and experience of natural values that underlie the conventio ad includendum regulating the social covenant.
The projection of these ethical principles onto the area of justice can be appreciated quite clearly if one considers that Justice - in its actual configuration - is done by exercising jurisdiction; thus, from a legal practitioner's standpoint, acting ethically means to respect the founding values of the jurisdictional system whether as a third party or not.
