Il diritto di superficie è un diritto reale minore di godimento disciplinato dall'articolo 952 e seguenti del Codice Civile, che consiste nell'edificare e mantenere una costruzione al di sopra (o al di sotto) di un fondo di proprietà altrui. La costituzione di questo diritto vale a sospendere il principio di accessione.

Black's Law Dictionary defines a ground lease as "a long-term (usually 99 year) lease of land only; such a lease typically involves commercial property, and any improvements built by the tenant usually revert to the landlord."
