A defense can either allege a failure to state a claim, or affirm the existence of a claim and present additional reasons that prevent the plaintiff or prosecutor from obtaining the result requested.

Разница между objection и defence заключается в том, что objection это некое «мелкое» возражение в процессе, например, против постановки какого-либо вопроса свидетелю, принятия доказательства и т.д., а defence это зачастую целая доктрина, на которой защита строит свои возражения по делу. Defence – как бы, линия защиты. Например, в качестве «defences to negligence» можно упомянуть «voluntarily assuming the risk (volenti)», «illegality», «contributory negligence». В общем, разница огромна.

Использование термина «способ защиты» для defence сильно собьёт с толку российского юриста, т.к., когда мы говорим о способах защиты, мы имеем в виду способы защиты гражданских прав, т.е. способы «нападения» (компенсация морального вреда, взыскание убытков), а когда в английском праве говорят о defences, имеют в виду способы защиты «от» нападения.
